By securing a charter or utilizing our Service, you consent to adhere to these Terms. Should you not agree with any portion of these terms, you will be unable to access the Service.
2. Service Overview
At CommonsInformationDeck, we offer luxury yacht charter services, inclusive of but not confined to:
- Daily yacht rentals
- Sunset cruises
- Corporate getaways
- Exclusive gatherings
- Extended charters
Our services are contingent on availability and climatic conditions. We retain the prerogative to alter or cease services at any given moment.
3. Booking and Reservations
3.1 Booking Process
When you wish to book a charter, you must:
- Be of minimum 18 years of age
- Provide accurate and up-to-date information
- Make an initial deposit as outlined in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is effectuated only after we have received your payment and provided our written acknowledgment. We preserve the right to decline service to any individual at our sole discretion.
3.3 Availability
Charter offerings are contingent upon the vessel’s availability and favorable weather conditions. We will endeavor to fulfill your preferred dates and timings to the best of our capability.
4. Payment Terms
4.1 Pricing
The prices we quote are in € and incorporate relevant taxes unless expressly stated otherwise. Prices are subject to revision at our discretion without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the aggregate cost of the charter due at the time of booking
- Remaining Balance: Must be settled 48 hours prior to the scheduled departure of the charter
- Incidental expenses (if applicable): Payable subsequent to the charter’s conclusion
4.3 Payment Methods
We accept a selection of major credit cards, bank wire transfers, and verified cheques. Payment processing utilizes secure, encrypted pathways.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If the cancellation is made more than 72 hours prior to departure, you will receive a complete refund minus any transaction fees.
- For cancellations made between 24 to 72 hours before departure, a 50% refund is issued.
- Cancellations made less than 24 hours before the departure time are non-refundable.
5.2 Weather Cancellations
In cases where our captain deems weather conditions as unsafe, we will propose to:
- Reschedule your charter to an alternative date at no extra charge
- Offer a full refund if rescheduling proves infeasible
5.3 Mechanical Issues
Should there occur any mechanical issues with the yacht designated for your use, we will strive to arrange a comparable substitution. If no replacement is achievable, we will proceed with issuing a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are obliged to:
- Adhere to all instructions given by the crew
- Employ safety equipment when necessitated
- Notify of any health conditions that may influence their safety
- Stay within prescribed zones of the yacht
6.2 Prohibited Items
The presence of the following articles on board is forbidden:
- Glass containers
- Illegal substances
- Firearms or other types of weapons
- Excessive quantities of beverages beyond moderate consumption
- Pets, unless with previous approval
6.3 Conduct
Passengers should display respectful behavior at all times. A charter can be terminated prematurely without a refund if passenger conduct endangers safety or interrupts other guests' experiences.
7. Liability and Insurance
7.1 Our Liability
We are bound in liability to the sum you have paid for the charter. We are not accountable for:
- Personal injuries occasioned by passenger mismanagement
- The theft or damage of personal belongings
- Secondary, consequential, or special damages
- Delays triggered by extreme weather or circumstantial elements outside our influence
7.2 Insurance Coverage
We uphold comprehensive marine insurance that covers our vessels and operations. Passengers should ensure they have acquired personal travel and property insurance.
7.3 Assumption of Risk
Engaging in our provided services denotes your acknowledgment of the inherent risks of marine activities and your acceptance of responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Itineraries, routes, or times may be altered due to weather conditions, safety reasons, or operational considerations. We will make every possible attempt to deliver comparable alternative experiences.
9. Force Majeure
We shall not be held accountable for any hold-ups, cancellations, or service adjustments due to events beyond our control, inclusive of but not limited to:
- Dire weather scenarios
- Natural catastrophes
- Regulatory decrees
- Port disruptions
- Functional malfunctions
10. Privacy and Data Protection
Your private data is processed according to our Privacy Policy. Utilizing our services signifies your assent to the collection and application of your information, as detailed within our Privacy Policy.
11. Intellectual Property
